These Terms and Conditions (“Terms”) govern your use of the website https://arkai-studio.com (the “Website”) and the services provided by Arkai Studio LLC (“Arkai Studio”, “Company”, “we”, “our”, or “us”).

By accessing the Website or purchasing any services from Arkai Studio, you agree to be bound by these Terms.

2. Services

Arkai Studio LLC provides creative and digital services, including but not limited to:

• Real Estate Branding 

• 3D Architecture Rendering 

• Website Design

• Logo Design

• Cinematic Visuals 

• Visual Assets and Digital Deliverables

All services are provided remotely and digitally unless otherwise agreed in writing.

3. Quotes and Project Agreements

All projects begin after:

1. a written agreement (email confirmation is sufficient), and

2. payment of the required deposit or full invoice.

Quotes are valid for 14 days unless otherwise specified.

We reserve the right to refuse any project request.

4. Payments

Payments are due according to the invoice terms.

• Projects under $1,000 require full upfront payment.

• Projects over $1,000 require a 50% upfront deposit.

• Work will not begin until payment is received.

Invoices are payable within 7 calendar days unless otherwise specified.

Accepted payment methods may include bank transfer, card payment, or approved payment processors.

Late payments may result in project suspension.

5. Refunds & Cancellation

Due to the custom and digital nature of our work:

• Deposits are non-refundable.

• Completed work and delivered files are non-refundable.

• If a project is cancelled by the client after work has begun, the client is responsible for payment for all work completed up to that point.

Arkai Studio reserves the right to cancel a project at any time. In such case, the client will receive a proportional refund for unfinished work.

6. Revisions

Unless otherwise agreed in writing:

• Branding projects include up to 2 revision rounds

• Website/UI and Visuals projects include up to 3 revision rounds
  
• 3D renderings projects include up to 3 revision rounds 

Additional revisions are billed at our hourly rate.

A “revision” means small adjustments to an existing concept. A new design direction is considered a new service.

7. Client Responsibilities

The client agrees to:

• provide required materials and information in a timely manner

• review deliverables promptly

• ensure they have legal rights to all content they provide

Delays in client response may result in project timeline extensions.

8. Intellectual Property

Ownership Transfer

Upon full payment, the client receives a non-exclusive, perpetual license to use the final deliverables for their business purposes.

Arkai Studio retains the right to:

• display the work in portfolios

• use the work for marketing and promotional purposes

Preliminary Concepts

Unused concepts, drafts, and proposals remain the property of Arkai Studio and may not be used by the client.

9. Third-Party Assets

Projects may include fonts, stock images, plugins, or third-party software licenses.
The client is responsible for purchasing any required commercial licenses unless otherwise stated.

10. Limitation of Liability

Arkai Studio LLC shall not be liable for:

• lost profits

• business interruption

• indirect or consequential damages

Our total liability shall not exceed the total amount paid for the services.

11. No Guarantees

We do not guarantee business results, marketing performance, search engine rankings, or revenue outcomes from the use of our services.

12. Termination

We may suspend or terminate services if:

• invoices remain unpaid

• abusive or inappropriate behavior occurs

• the client violates these Terms

13. Governing Law

These Terms shall be governed by and construed under the laws of the State of Wyoming, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms at any time. Continued use of our Website or Services constitutes acceptance of the revised Terms.
